Coinbase’s FOIA Settlement Victory: A Call For SEC Transparency and Accountability

Coinbase FOIA Case 

Grewal reported on the SEC-Coinbase FOIA lawsuit settlement, highlighting a legal win for crypto exchanges pursuing regulatory clarity. 

The FOIA case covered Coinbase pursuing SEC document on crypto regulation after a major development in the creation of new crypto policies. 

Coinbase pursued the records to be aware of how the SEC developed its crypto enforcement strategy. The document indicated the regulatory review such as Ether Delta founder Zachary Coburn, Enigma MPC, and Ethereum’s shift to a proof-of-stake model in 2022. 

The SEC declined Coinbase’s request, noting FOIA exemptions for law enforcement records, which led Coinbase to pursue legal action against the agency and FDIC in 2024. 

Coinbase noted the missing Securities and Exchange Commission (SEC) records in relation to the agency’s crypto enforcement actions. 

Paul Grewal pointed out the issues over “Operation Choke Point 2.0,” indicating FOIA lawsuits seeking transparency on regulators’ treatment of the crypto sectors. 

He further noted that Coinbase’s FDIC settlement reported documents indicating limitations on crypto activities, causing congressional hearings and a court ruling. Coinbase’s lead lawyer also underscored concerns over excessive government authority and the need for fair treatment and transparency beyond the crypto industry. 

SEC Coinbase Settlement 

The SEC settlement reported missing senior officials’ correspondence during crypto enforcement. The case came from missing SEC correspondence, including removed messages from former Chair Gary Gensler despite the FTX collapse and increased regulatory scrutiny. The regulatory review found that Gensler’s device reset led to the loss of data, with restored messages indicating discussions related to SEC crypto enforcement. As part of the settlement, the SEC will compensate Coinbase with a $150,000 award and modify its records of management policies. 

Coinbase and its executive have currently backed efforts for more transparent crypto regulations, such as the GENIUS and CLARITY Acts. During the Trump administration, the SEC pursued more crypto-friendly policies, while Coinbase CEO Brian Armstrong and Paul Grewal continued advocating for the CLARITY Act. 

Regulatory ambiguity has continued to be a significant issue for the crypto sector. In addition to the FOIA case, Coinbase faced challenges such as uncertain regulatory actions, mainly banking access, and remains to promote a stronger agency of accountability and transparency. 

Grewal also pointed out the need for government transparency and accountability, citing that Coinbase will remain seeking legal action when necessary.
